§ 1 Scope
These Terms and Conditions (T&Cs) apply to all claims arising from contracts concluded between CT-Lenksysteme and the buyer (hereinafter "the Buyer") via the website www.ct-lenksysteme.eu, in their valid version at the time of the order. The seller primarily offers power steering pumps for vehicles. The following terms and conditions, as well as the contract text, are written in German and can be downloaded and printed by the buyer. Upon request, they can also be provided in digital or written form via email at support@ct-lenksysteme.eu.
§ 2 Conclusion of Contract
- The customer can select products, especially power steering pumps for vehicles, from CT-Lenksysteme's range and add them to a virtual shopping cart by clicking the "Add to Cart" button. They can also request repairs or replacements of the pump. By clicking the "Buy Now" button, the customer submits a binding offer to purchase the selected goods. Before submitting the order, the customer can review and change their data at any time; they can correct input errors (e.g., via the back button or cancel the order process and modify their entries). The offer can only be made and transmitted if the customer accepts these terms and conditions by clicking the "Accept Terms and Conditions" button, thereby including them in their offer.
- CT-Lenksysteme then sends an automatic acknowledgment of receipt via email, listing the customer's order, which can be printed. This acknowledgment only confirms that the order has been received by CT-Lenksysteme and does not constitute acceptance of the offer. The contract is only concluded when CT-Lenksysteme explicitly accepts the order by sending a separate email (order confirmation). This email, or a separate email, will include the contract text (order, T&Cs, and order confirmation) on a durable medium (email or paper). The contract text is stored securely and can be requested in digital or written form at support@ct-lenksysteme.eu. The buyer will be informed by email once the goods have been handed over to the shipping company.
- The contract is concluded in German.
§ 3 Services and Prices
- CT-Lenksysteme strives to provide accurate images of the offered items. Slight color deviations are possible.
- The total price of the goods, including all components and applicable taxes, as well as payment options, are specified in the product description. All prices are final, excluding shipping costs, and include the applicable VAT at the current rate.
- The buyer can pay via prepayment/bank transfer, cash on delivery, PayPal, or cash (for self-collection only). If the payment method is prepayment, the bank details will be provided in the order confirmation.
§ 4 Delivery, Availability, and Retention of Title
- The shipping costs are specified in the respective offer under "Shipping." Shipping is usually within 2-3 business days after payment receipt. Shipping is via DHL unless otherwise agreed. CT-Lenksysteme bears the risk of shipment if the buyer is a consumer.
- If the selected product is not available at the time of the order, CT-Lenksysteme will inform the buyer immediately in the order confirmation. If the product is permanently unavailable, CT-Lenksysteme will decline to accept the order, and no contract will be formed. If the product is temporarily unavailable, the buyer will also be informed immediately.
- If delivery is delayed by more than two weeks, the buyer has the right to withdraw from the contract. The statutory right of withdrawal (see § 6) remains unaffected. In such cases, CT-Lenksysteme may also withdraw from the contract, and any payments already made will be refunded immediately.
- The delivered goods remain the property of CT-Lenksysteme until full payment is received.
§ 5 Replacement Parts / Old Part Deposit
- For exchange parts, no deposit is initially charged. When purchasing an exchange part, the buyer agrees to send the replaced or removed component to the seller after receipt of the new part. The component must be complete and match the original in type and construction.
- If CT-Lenksysteme does not receive the component within 2 weeks, it reserves the right to charge a flat fee of €100 for the old part deposit.
- CT-Lenksysteme covers the return shipping costs for the old part. Please use the return label provided with your order.
§ 6 Right of Withdrawal for Consumers
For contracts concluded between CT-Lenksysteme and the buyer via www.ebay.de, the law considers it a distance selling contract under § 312c para. 1 BGB. Consumers (as defined by § 13 BGB) have a statutory right of withdrawal according to §§ 312g, 355 BGB. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. Further information about the right of withdrawal can be found in the separate withdrawal policy. A withdrawal form can be used but is not mandatory.
§ 8 Warranty and Guarantee
- CT-Lenksysteme is liable for material defects according to the applicable legal provisions, especially §§ 434 ff. BGB. The warranty period for goods delivered by CT-Lenksysteme to entrepreneurs is 12 months.
- An additional guarantee is only provided if explicitly stated in the order confirmation for the respective item.
- Any seller guarantees or manufacturer warranties provided by the manufacturer are in addition to claims for material or legal defects. Details of such warranties are specified in the warranty conditions accompanying the products.
§ 9 Liability
- Claims for damages by the customer are excluded, except for damages resulting from injury to life, body, or health, or from the breach of essential contractual obligations (cardinal obligations). Liability for other damages caused by intentional or grossly negligent conduct by the provider, its legal representatives, or vicarious agents is also excluded. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.
- In case of breach of essential contractual obligations, the provider is only liable for foreseeable damages typical for the contract if caused by simple negligence, unless claims for damages due to injury to life, body, or health are involved.
- The limitations of liability in paragraphs 1 and 2 also apply to the legal representatives and vicarious agents of the provider if claims are asserted directly against them.
- The provisions of the Product Liability Act remain unaffected.
§ 10 Final Provisions
- Contracts between CT-Lenksysteme and the buyer are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
- If the buyer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from the contractual relationship is the registered office of the provider.
- European Commission platform for online dispute resolution: https://ec.europa.eu/consumers/odr
- The contract remains binding even if individual provisions are legally invalid. In such cases, the invalid provisions are replaced by the applicable statutory provisions. If this would cause an unreasonable hardship for a contractual party, the entire contract shall be deemed invalid.
Alternative Dispute Resolution pursuant to Art. 14(1) ODR-VO and § 36 VSBG
The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
